For service members, divorce can become a lot more complicated. There are several issues that differentiate your divorce from a civilian divorce, including the following:

  • Location: the court that grants your divorce must have jurisdiction to do so, meaning you and your spouse should live in the same area as the court. In military divorce, you and your spouse may be separated due to deployment. If you and your spouse do not live together, then you may file for divorce in a state where either of you live, so long as you both agree to it. For example, if you live in Hawaii, and your spouse lives in California, then you may file in Hawaii or California.
  • Alimony & Child Support: both civilian and service member parents are required to contribute child support. If you fail to do so, then the military may punish you in addition to state penalties. Calculating the amount of a child support that a military spouse must pay is a bit complicated due to all the benefits and allowances. Instead of using a tax return, the courts use the Leave and Earnings Statement, which is equivalent to a military pay stub.
  • Pensions and Military Benefits: Because the military is still viewed as an employer, benefits such as life insurance, medical and pensions benefits are subject to be divided with your spouse. Review your state laws to find out exactly what is protected in a military divorce.
  • Custody and Visitation: For military members who frequently move around, visitation and custody can become infinitely more complicated. In creating your parent plan, you may have to make arrangements for your children when you or your military spouse is deployed or relocates.
