What Does "Temporary Restraining Order" Mean? How Does a TRO Work?
When domestic violence, harassment, or stalking occurs, the victim can a temporary restraining order (TRO) against the aggressor to prevent him/her from coming into contact with the victim.
Once a TRO is served to the aggressor—or respondent—any form of contact, threats, or abuse made to the victim—or petitioner—can lead to a conviction that is punishable by a minimum 48-hour jail sentence and a fine of up to $500 for the first offense in Hawaii. The consequences alone may deter respondents from interfering with the petitioner’s life.
How to File a Temporary Restraining Order in Hawaii
Petitioners may file a TRO in District Court, where a court officer will help you complete the necessary forms. However, if you wish to fill these forms out before you go to court, you may download them from the Hawaii State Judiciary website.
If the TRO is granted, you will be required to serve a copy to the respondent. If you don’t want the respondent to know your phone number or where you live, you must let the clerk know.
There is a fee to file for a TRO. In Hawaii, a temporary restraining order costs $15, but the fee can be waived if exceptional circumstances are evident.
The following are the important details you must provide to the court to file a TRO:
- Documents about the abuse, such as police reports and medical records
- Dates of the abuse or threats
- Description of physical or emotional abuse
- Whether or not the abuser owns a firearm or has used it to threaten you
- If you are 17 years of age or younger, the name of a parent or legal guardian
How Long Do Temporary Restraining Orders Last?
Once the TRO is granted, an injunction hearing will be held within the next 15 days. In this hearing, the court will decide whether to extend the restraining order beyond 90 days.
