How Hawaiʻi Law May Affect Your Divorce
A Hawaiʻi Family Court may grant a divorce after finding that the marriage is irretrievably broken. The proceeding can also address equitable distribution of marital property and debts, child custody and visitation, child support, and spousal support. Filing location and jurisdiction depend on the parties’ circumstances, with Honolulu cases generally proceeding in the Family Court of the First Circuit.

Biology isn’t always the only factor in determining a person’s legal relationship to a child. A parentage presumption can allow someone to be recognized as a parent based on specified circumstances, such as when a child is born during a marriage or within a statutory period after it ends. It doesn’t necessarily mean dividing every account, debt, or asset equally. A prior civil union or domestic partnership may raise additional questions about when the couple’s financial relationship began and which legal framework applies. Spousal support requires a separate analysis of case-specific financial information under Hawaiʻi law.
