Boating Under the Influence (BUI) DETERMINED TO FIGHT FOR YOU

Boating Under the Influence Defense in Honolulu

More Than 30 Years of Litigation Experience in Honolulu BUI Defense

I challenge boating under the influence evidence by examining who operated the vessel, what officers observed, and how chemical testing was handled. At Law Offices of Steve Cedillos, I represent people facing boating under the influence (BUI) allegations in Honolulu and Kailua, including recreational boaters, jet ski operators, and kayakers.

These allegations can affect a person’s freedom, driving privileges, and ability to operate a vessel in state waters. A boating stop can create immediate testing questions followed by criminal and administrative proceedings, so each stage deserves careful attention.

Call (808) 201-0496 now to discuss the allegation and the legal decisions ahead.

How Hawaii Law Defines Boating Under the Influence

Hawaii Revised Statutes §291E-1 defines a vehicle to include a vessel, meaning a watercraft used or capable of being used as transportation on or in the water. This broad definition can cover motorboats, personal watercraft, kayaks, and other watercraft.

Under HRS §291E-61, operating or assuming actual physical control of a vessel while impaired by alcohol or drugs can support a charge of operating a vehicle under the influence of an intoxicant (OVUII). This concept generally concerns whether someone had present control over the vessel, even when active navigation is disputed. Hawaii law covers navigating or otherwise assuming physical control of a vessel underway in state waters.

The statute identifies these alcohol concentration thresholds:

  • Breath testing: .08 grams of alcohol per 210 liters of breath.
  • Blood testing: .08 grams of alcohol per 100 milliliters of blood.

Chemical Testing Can Trigger Separate Criminal & Administrative Proceedings

Hawaii’s implied consent law treats operating a vessel on state waters as consent to breath, blood, or urine testing under qualifying circumstances. The law connects the privilege of operating with submission to an authorized chemical test. Refusing a requested test can result in automatic license suspension.

A BUI arrest can create two distinct tracks. The criminal charge proceeds through the court system, while the Administrative Driver’s License Revocation Office (ADLRO) handles the separate administrative revocation process. Administrative revocation can terminate the privilege to operate a vessel underway on state waters and may affect driving privileges.

For a first offense under HRS §291E-61, possible sentencing terms include a substance abuse program, license revocation, and ignition interlock use during the revocation period. The court may also impose community service or jail. The consequences depend on the charge, evidence, prior record, and statutory provisions applied to the case.

What Happens After a Honolulu BUI Arrest

After a water stop, law enforcement may record observations, take statements, and request breath, blood, or urine testing. I review whether the person was navigating or controlling the vessel, whether the evidence supports impairment, and whether the test procedures produced reliable results.

The ADLRO track and criminal proceeding involve separate decisions and consequences. Honolulu criminal OVUII and similar DUI-type proceedings commence in the District Court of the First Circuit. Because plea bargains aren’t available in every Hawaii DUI matter, I don’t assume negotiations will resolve a charge.

Evidence I Examine in a BUI Defense

I take an aggressive approach to challenging the government’s impairment and alcohol concentration evidence while evaluating the individual facts behind the allegation.

A defense review can address:

  • Whether law enforcement had a lawful basis for the stop.
  • Whether the accused was operating or controlling the vessel.
  • Whether observations attributed to impairment had other explanations.
  • Whether chemical testing procedures were followed and evidence was handled properly.

    "This guy was awesome"
This guy was awesome, he spoke to me for about thirty minutes and told me that I probably didn’t need his services. He could have charged me anyway so I appreciate that.

"Would I hire him again? Absolutely."
I hired Steve for a child custody case in 2021. I see all the reviews that say he is "mean" or "rude" - I would say that he is just blunt and straightforward. He isn't going to get your hopes up just to preserve your feelings. Great guy. he is willing to answer your questions before you even hire him and you can bet that he's honest. Do I think that a 5k retainer was a lot for my case? Yes, but it IS Hawaii and I did hire him 2 months before my actual trial date after going pro-se for a while. Would I hire him again? Absolutely.
