What Hawaii Law Actually Calls a DUI
Hawaii doesn’t use the term “DUI” in its statutes. The official charge is OVUII, or Operating a Vehicle Under the Influence of an Intoxicant, governed by Hawaii Revised Statutes §291E-61. The two terms mean the same thing, and I’ll use both throughout this page. A first offense is classified as a petty misdemeanor.
The legal blood alcohol concentration limit is 0.08% for most adult drivers, 0.04% for commercial drivers, and 0.02% for drivers under 21. A driver can also be charged at a lower BAC if the officer observed enough impairment to support the arrest. One more important point: Honolulu courts generally don’t offer plea bargains on DUI charges. That makes the quality of your defense strategy critical from the very first court date.
Penalties for a First Offense DUI Conviction in Honolulu
Under HRS §291E-61, a first conviction carries fines ranging from $250 to $1,000 and a license revocation of no less than one year and no more than eighteen months. The court may sentence a first offender to any one or more of the following: 72 hours of community service, 48 hours to 5 days of imprisonment, or a fine. Because those are alternatives, a judge can resolve a standard first offense without imposing jail time, but jail remains on the table when aggravating factors are present.
Those aggravating factors include an elevated BAC, driving with children in the vehicle, involvement in an accident, reckless driving, a combination of drugs and alcohol, out-of-state DUI convictions, or zero-tolerance situations. A first conviction also may require installation of an ignition interlock device (IID) on vehicles operated during the revocation period. The IID is a breathalyzer wired into the vehicle that must register a passing breath sample before the engine will start.
The formal penalties are only part of the picture. A conviction can raise insurance rates substantially, appear on employment background checks, trigger review by professional licensing boards, and affect base access or security clearance eligibility for personnel working near Joint Base Pearl Harbor-Hickam.
The ADLRO Hearing: Your License Is at Stake Before the Criminal Case Resolves
When a driver is arrested for an alcohol-related OVUII in Hawaii, the arresting officer issues a Notice of Administrative Revocation (NOAR) and takes the physical license. The NOAR serves as a temporary driving permit for 30 days. After that window closes, the Administrative Driver’s License Revocation Office conducts a separate hearing that determines whether your license can be suspended, entirely independent of the criminal case.
Deadlines, Hearing Standards, & What the Outcome Means
Strict deadlines apply to requesting an ADLRO hearing. Missing the deadline means automatic suspension with no opportunity to be heard. At the hearing, the officer reviews three core questions: did the officer have reasonable grounds to stop the driver, was the driver properly informed of their rights, and were chemical test results obtained in compliance with Hawaii law?

Implied Consent & Chemical Test Refusal
Hawaii’s implied consent law means that by driving on public roads, drivers agree to submit to breath, blood, or urine testing when suspected of OVUII. Refusing a chemical test is itself a basis for license revocation, with revocation periods that can equal or exceed those imposed for a failed test.
How a First Offense DUI Defense Is Built
A failed breath test doesn’t end a case. Breathalyzer devices can produce inaccurate results from improper calibration, device malfunctions, or human error. I review maintenance and calibration records for every breath test machine involved in a client’s case.
For blood tests, the defense examines the collection process, how the sample was stored, and the method used for analysis. Breaks in the chain of custody can undermine a result that looks damaging on paper. Certain medical conditions, including diabetes, and some dietary patterns can also produce false elevated BAC readings on breath tests.
The initial traffic stop must also be evaluated. A stop without probable cause can be grounds to suppress all evidence gathered after it, including test results, which may lead to dismissal. Field sobriety tests carry their own vulnerabilities: they don’t account for health conditions, coordination issues, vision problems, uneven pavement, poor weather, stress, or improper administration by the officer. Body camera footage and records from the Honolulu Police Department frequently reveal procedural inconsistencies that challenge the prosecution’s account.
