Hawaii calls this offense operating a vehicle under the influence of an intoxicant, or OVUII. In a drug OVUII case, the central question is whether a drug impaired the person’s ability to operate a vehicle carefully and prudently. The presence of a measurable substance in blood or urine doesn’t answer that question by itself.

The Criminal & License Proceedings Are Separate

A drug-related arrest can trigger two proceedings. The criminal case addresses the charge and possible sentence, while the administrative process addresses driving privileges through the Administrative Driver’s License Revocation Office.

One proceeding doesn’t automatically determine the other. Administrative requirements may also differ depending on whether the allegation involves drugs, alcohol, a test refusal, or other circumstances. I appear before the Administrative Driver’s License Revocation Office and in Honolulu District Court, allowing me to address both tracks without treating the license matter as an afterthought.

My OVUII practice extends from first-time misdemeanor charges through vehicular manslaughter cases. The appropriate strategy depends on the alleged conduct, prior enforcement history, testing circumstances, and evidence.

Evidence That May Shape a Drugged Driving Defense

A defense review should examine how the investigation began, what officers observed, when any sample was collected, and whether the evidence reliably connects alleged impairment to the time of driving.

Important evidence may include:

  • The traffic stop: The stated reason for the stop, reported driving behavior, body-camera footage, and officer observations.
  • Roadside testing: Field sobriety testing, the officer’s instructions, environmental conditions, fatigue, and medical limitations.
  • Drug evaluation: A Drug Recognition Expert evaluation conducted by an officer trained to document signs associated with different categories of drugs.
  • Toxicology: Blood or urine collection, testing time, laboratory methods, sample handling, and chain of custody.
  • Statements: Recorded or written answers about prescriptions, medication use, symptoms, and other circumstances.

A valid prescription doesn’t necessarily prevent a charge, but it also doesn’t establish unlawful impairment. I focus on what the evidence shows instead of assuming that drug detection and impaired driving are the same.
